These Terms & Conditions ("Terms") govern your access to and use of the Power Tools for Coaches suite — Assess360, A Video Router, VidaPulse, LeadEngine, Cloudz Copy and Pulse Email (the "Services") — provided by DivineLeads ("we", "us"). By creating an account or using the Services, you agree to these Terms.
1. Eligibility & account
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your registration details and for keeping your credentials secure. You are responsible for all activity under your account.
2. Free plans & paid upgrades
The Services are free to start. Certain features, limits, or volumes require a paid plan. Pricing and plan details are shown at the point of upgrade and may change with notice. Where a plan renews, it renews at the then-current rate unless cancelled.
3. Acceptable use
- Do not use the Services for spam, unlawful, deceptive, or harmful activity.
- Do not send email or messages to recipients without a lawful basis or required consent.
- Do not upload malware, infringe others' rights, or attempt to disrupt or reverse-engineer the Services.
- You must comply with the terms of any third-party service you connect (cloud providers, SMTP servers, payment gateways).
4. Your content & data
You retain ownership of the content and data you upload or process. You grant us a limited licence to host and process it solely to provide the Services. You are responsible for the legality of your content and for the data you collect from your own contacts.
5. Third-party connections
The Services let you connect third-party tools. We are not responsible for those services, their availability, or their terms. Your use of them is governed by their own agreements.
6. Payments
Payments are processed by third-party payment providers. By purchasing, you authorise the applicable charges. Refunds are governed by our Refund & Cancellation Policy.
7. Service availability
We aim for high availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.
8. Intellectual property
The Services, including software, design, and trademarks, are owned by DivineLeads or its licensors. These Terms grant no ownership rights in the Services.
9. Termination
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms or misuse. On termination, your right to use the Services ends; certain provisions survive.
10. Disclaimers & limitation of liability
The Services are provided "as is" without warranties of any kind, as further described in our Disclaimer. To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid us in the 3 months preceding the claim.
11. Governing law
These Terms are governed by the laws of India, and the courts at our place of business shall have jurisdiction, subject to applicable law.
